"Hit and Run, Misdemeanor or Felony"

"In review of the current ruling in Pennsylvania on a "hit and run" accident, is a crime committed if the individual did not know someone was hit, if so what stipulations is it considered a misdemeanor or a felony?"

I'm not licensed in PA, so you might want to consult a local attorney, but generally speaking ANY criminal offense requires knowledge and intent.So if the driver did not know anyone or anything was hit, there would be no offense.... but persuading a judge or jury you were unaware may be a problem.If you find out after the fact, do the right thing and report your involvement to the police. That is not only the right thing, but it will likely reduce the risk of any charges for hit and run (though I strongly urge consulting a local criminal defense attorney with respect to turning yourself in -- an attorney may be able to arrange it so you are released on your own recognizance and do not have to post bond or spend any time in a jail cell).
