Legal Question in Criminal Law in Pennsylvania

moving hearing dates

My girlfriend is in jail right now in the Phila. Prison System. She is charged with faulse ID,retail theft and 2 Probation violations.

She has gone to court 2 times for the retail theft and CVS hasn't shown up. After the third time the charges get dropped. That hearing is Dec 6 2008. Her violation hearing isn't until Jan 09. She would like to have the CVS hearing and her violation hearings moved up. We have an attorney, but he says that can't be done. I really have to question his abilities. He has not done anything yet to help her.

Can the retail hearing and violation hearings get moved up? Again he says they can't be moved

Re: moving hearing dates

The retail theft cannot be moved up (none) and there is no guarantee that it will be thrown out if they don't show up.

The violation hearing might be able to be moved up, but it is a tricky thing. You actually may not want it moved up. Also, if you beat the CVS case, you may be able to get the violation listed quickly thereafter and not wait the 33 days, especially during the holidays.

good luck
