Legal Question in Criminal Law in Pennsylvania

Notification of a hearing for my minor child

My 16yr old daughter was involved in a traffic accident. Because she was driving on her learners permit (there was an adult passenger) and it was after midnight curfew (Pittsburgh) the accident was deemed her fault. I have been sent a letter to appear in juvenile court for her hearing. I cannot be there, as I live in Missouri. Her father, who lives in Pittsburgh, has joint custody and primary physical custody. He has also received a letter. Do I legally have to be there? What are my risks if I cannot attend? If an emergency arises and he cannot attend, will it be sufficient if his lawyer attends?

Re: Notification of a hearing for my minor child

Well, first off, it is clear that your daughter is being charged with something criminally. Otherwise, you wouldn't be in juvenile court. You didn't indicate what she is being charged with.

An accident doesn't become someone's fault because of a curfew. She may be being charged with driving outside the parameters of her license.

While they prefer both parents to be there, if your husband has primary physical custody, as well as joint legal custody, then he should be there. No, he cannot skip it and send his lawyer.

Your daughter needs a lawyer. You should consult one ASAP.
