Legal Question in Criminal Law in Pennsylvania

questionnaire for public trust positions

I am filling in the survey for a USDA-ARS position on a fort and i have to get secret clearance. Three years ago i was caught with marijuana and i used section 17 to remove it from my record because i was 18 at the time. The form asks ''In the last 7 years, have you been arrested for, charged with, or convicted of any offenses?'' SHould I list this?

Re: questionnaire for public trust positions

The fully honest answer is that you were arrested but not convicted, as the case was dismissed.

The USDA is obviously going to check your record. Section 17 allows for an expungement. If your record was PROPERLY expunged, even the federal government would find no record of it.

In this case, you should answer that you were arrested but not convicted, and that the charge was dismissed.
