Legal Question in Elder Law in Pennsylvania

Bad POA

My sister says she is moms POA (but she still puts a pen in moms hand and then moves her basically signing moms name herself) maybe its not in effect as mom to my knowledge has never officially been deemed incompetent but she is and has severe dementia. If she legally is or isn't POA I don't know (she runs the show)her and the lawyer are very secretive and won't show me any documents and tell me its known of my bus if I ask a question. This lawyer was just arrested the other day for stealing 1 million dollars from another client and I hear he got mom for at least 100k..and she also let him invest alot of moms ''for the rest of her life money'' in risky internet stocks and lost her 400k a few years back. I live with my mother and am the caregiver can I challenge this POA or not POA in court to protect mom? If she was not so secret and I had some say she definately would not have been a victim of theft from her lawyer and I definately would not invest that much money in risky (at best) internet stocks for a 85 year old women...it is negligence at best - a crime at worst...

it is difficult to advise you without more information. There are time periods in which you must bring an action against a person. In any event if wht you say is accurate both the attorney and your sister at lease would seem to no be working in the interest of your mother. You should immediately make an appointment with an attorney and perhaps seek to have a guardian appointed for your mother and if a POA exists have your sister removed by court proceeding.
