Legal Question in Family Law in Pennsylvania

My daughters boyfriend went to jail for drugs and robbery and get out in a week. She

has a 3 1/2 old and he has not paid any child support, does he have a claim or right to see this child?

Unfortunately yes. Whether the non-custodial parent pays support or not it has no effect on custody rights.

That said the drug conviction will have serious impact on the type of partial custody or visitation the child's father can get. That's the one thing that jumps out from what you wrote. There maybe other issues that hurt his custody rights.
