Re: dead beat ex husband

You asked about a debts that may be levied against your girlfriend.

In your particular circumstance and for the specific item you mention (a car), the creditors can place a lien against the car if the debt is reduced to a judgment. Such a lien would be subject to any priority lien, such as where the lender has a lien on the title.

The creditor cannot seize the vehicle so long as it is not owned solely by the debtor party. What could happen, is that the creditor first obtains a judgment and then files a lien on the car. The car's title couldn't be sold unless any lienholders were paid to the extent permissible. In this case, the creditor could only levy against half of the value of the car after the more senuor lienholders are paid.

Regards,

Roger
