Legal Question in Family Law in Pennsylvania

legal change of guardian

My question is my husband had a baby by an ex-girlfriend almost seven years ago at the time the baby was born she told my husband she wanted him to give up his rights and she was changing the baby's name to her boyfriends and he was his going to be his legal guardian my husband told her ok whatever because of issues he had to deal with her...anyway now she filed a claim to get child support from my husband even after the child is now almost seven has her boyfreinds last name as has been for all these years never allowing my husband to see the child because he was supposed to be legally adopted by her boyfriend..I just want to know what we can do if we can fight not having to pay the support please help me.

Thank You

Re: legal change of guardian

All non custodial parents have a legal obligation to pay support for their children. Since your husband is still the child's legal father, he has an obligation to pay.

The good news is that he also has rights to custody. She can be made to understand that she cannot have one without the other.
