can a parent with shared legal and shared custody be the abducting parent if the child is not returned per the court order

I am not clear on what you mean by being the "abducting parent". If you have the child and do not return the child and there is a court order, and your not returning the child violates the terms of the order, the police can enforce the order, and you can be held in contempt of the Order, resulting in possible attorneys fees and costs. It could also jeopardize your custody rights. If you want to change the order, you need to file to modify it. My office can handle that.
