Legal Question in Medical Leave in Pennsylvania

Metally ill and could get FMLA papers from employer now I am fired.

About 4 weeks ago, I had a melt down at work. I left work pulled over on side of road and 911 was called. At which time I spent nearly 4 weeks in an out-patient program for my illness. My wife called about 25 times trying to get FMLA papers from my employer no such luck. With no money coming in and feared the worst of loosing everything I just return to work on Monday, I had a melt down when my shift was over but I talked myself through it. I had 2 Drs appt, on Tuesday, at whcih time I did tell them, and told them that I would try to come in. I thought everything was ok. I went to my first appt in the am got to work after that worked about an hour and wasnt feeling right at all so I told my boss I didnt feel well and I had to leave. Well He brought me in his office and told me Since I was mentally ill I am a liability to the company and not to return!! I went home and files for unemployment but someone told me about short term disability. When I called the human resourse department to fins out they said they would call me back and still no one has called me back!! What am I to do?!

My other drs. appoint was later in the evening in which I had to go so He gave me a note stating that I was to be out of work until the 21st of Oct

Re: Metally ill and could get FMLA papers from employer now I am fired.

You asked about getting fired.

Rather than short term disability it seems you may have claims under both the Americans with Disabilities Act and FMLA.

You need to contact an attorney immediately to discuss these matters.

Roger
