Legal Question in Federal Tort Claims in Pennsylvania
auto accident medical bills
Recently My 11 year old daughter and I was in a car accident. A lady driving too fast for road conditions totaled my vehicle. She was cited and 100% at fault. My question is when I recieve the pain and suffering settlement am I responsible for paying back the medical bills to my insuranced company? I hope to settle this out myself because a law suit would take up to 2 years and I can not financially afford to wait for lost wages until then. I was just getting by before this. I just really need to know if about the med. bills so they don't come back to haunt me. I have read in different places that if you do recieve a settlement you have to reimburse your insurance company what they paid out fot you. I live in PA..I don't know if that matters. Thank you greatly.

You are selling yourself and your daughter short.
If you want a quick settlement, an attorney can facilitate that -- and by law, you retain total control of when to settle and for what amount.
Also, though not recommended by most attorneys, you can 'sell' your claim to a finance company which will provide you cash quickly.
The answer to your question about bils is: it depends. Typically, you are responsible, but your attorney can negotiate a better rate for that reimbursement. And that's just one reason you need a lawyer.
Seriously, don't DIY a viable claim. Even personal injury lawyers, when injured, find representation. It's that important.
