Is this a crime?

If you receive a check in your name from a company that you know for a fact was sent in error, that the money does not belong to you, but you still deposit it into your bank account is this a crime?

Yes it is. I know of one bank that told a depositor (in upstate New York) that the $26,000 that appeared in their account was their money not a bank error. After tiring of fighting the bank they took the money. The bank had them arrested and tried for theft.

So give the money back or if they refuse put the money aside and be prepared they'll ask for it back.
