Legal Question in Civil Litigation in Pennsylvania

Can I fight this harassment charge

My husband got a non traffic summary for a harassment fine against our nieghbor. This all started with a furnace . My husband painted on the furnace chimney and on our property. The one sign says got smoke? and the other one says how's this. Our nieghbor called the police (on 2-29) we got this today 3-17-04 . He claims that we ''the defendent did with intent to harass, annoy or alarm another person by engaging in a course of conduct which serve no legitimate purpose and communicates in an anoymous manner.'' now we were not anonymous and we did not harass him, we feel we are entitled to freedom of speech/press. any help?

Re: Can I fight this harassment charge

I suggest you consult with legal counsel. You can demand a hearing to contest this offense. You must call the District Justice and enter a plea of not guilty. You also have a right of appeal if you lose. Unfortunately there are no winners in a neighbor dispute. If you can not make peace with your neighbors I suggest the issues between you will not be resolved until one of the parties sells their property and move. I am sure there are many other issues and the issue you have described is just one of them. Gerald Hershenson Esq. 215-579-9390
