Vehicle Damage in Automatic Car Wash

My vehicle was damaged at an automatic car wash operated by Uni-Mart. The tire was slashed by a guard rail when I bumped it while driving in. There is a sign on the wall stating ''operator is not responsible for damage''.

The company has rejected my claim for damages. Do I have a chance in small claims court?

I think you have a chance. I do not believe that the car wash can avoid liability for negligence simply by posting a sign. The questions the judge will have to consider is "was the car wash negligent? -- or were you contributorily negligent in failing to avoid the guard rail". I don't think the sign has anything to do with the case. But remember--this is only my opinion.
