Deportation Questions

My child's father and i were engaged when he was convicted of a non- violent, first offense felony and recieved a sentence of 4-8 years. He has already served more than a year and has apparently recieved a letter stating he will be deported and he has until October to appeal. I am trying to get information on what can be done in this situation. what are the laws in Pa regarding crime and deportation? My son is missing his Dad and they had a very close relationship.

You asked about potential deportation after incarceration.

The individual needs to hire an immigration lawyer with experience handling criminal deportation orders.

Immigration is a federal matter and has little, if any, nexus with state law. If an inmate fails to appeal then they will generally be forcibly deported immediately upon release. There are ways to get around deportation and an experienced attorney can find the means to get the necessary exception.

Don't delay and make sure the inmate gets an attorney immediately.
