Legal Question in Insurance Law in Pennsylvania

Auto vs Bicycle Liability

Our 17 yr old was involed in an accident yesterday with a 13 yr old on a bike. The boy on the bike was at fault as he came out of a one way street going the wrong way without stopping and ran into the front of her car and sustained minor injuries. Is there any way his parents can come back on us for medical liability? And who is responsible for paying for the $2K plus damage done to her car which only had liability insurance?

Re: Auto vs Bicycle Liability

You asked about liability in an accident.

The liability of primary fault would be ascribed to either the person who was in error or the person who had the last clear chance to avoid.

Generally parents can be held responsible for the torts of their children. You will need to contact the parents of the child and their homeowner's insurance will probably afford coverage.

Otherwise you could seek legal advice and prosecute a claim.

Roger
