Automobile accident--Not my fault!

A truck was rounding a curve on my side of the road. His left front fender hit my left front side between the drivers' door and the front wheel. He then pushed us into the guard rails. He was on my side of the road; and he was cited for the accident.

My left arm is badly bruised from the shoulder to the elbow. I have a bruise on my collar bone on the left side. My left leg has a bruise and my right arm has a bruise. My husband (who has a bad back and neck--2 back operations previously) got whiplash.

My insurance is paying the loan company the balance of the loan which they say is the car's value. My question is--the accident was not my fault--I don't have my car because of the accident; but I do not have anything to show for the amount I had already paid on the car--do I deserve to be paid more by his insurance company.

Also, for pain and suffering his insurance company said they can give my husband and me about $850.00. They said maybe a little more--but a figure like $6000.00 would be IF there were some broken bones. What about paid and suffering? We don't know where our injuries will lead. I missed 5 days of work which was reimbursed by his insurance company; but I feel we deserve more. It wasn't my FAULT!

If you had "full tort" coverage you can clearly collect damages for pain and suffering. Obviously. the insurance adjuster is trying to keep you from seeing a lawyer to know the truth. I don't know how much your case is worth--it depends on many factors--but to tell you that you need fractures before you can get 6,000 is dead wrong. You should contact an attorney immediately.
