Legal Question in Insurance Law in Pennsylvania

My insurance company is holding up paying a claim to my costumer because they say it was reported late. The claim occured in 8/08 and I called my agent the next day. The agent did not turn it in and now can't remember. My customer is threatening to cut me off. This will close my company down. What can I do?

It would appear to me if the facts as related are correct, that the agent as an agent for the insurance company would bind the insurance company as to the timing issue. Do you have any confirmation of the call to the agent either by telephone records or otherwise. Of course the Agents statement that he does not remember does help the issue. Did you have any record of followup calls etc. perhaps you should consult with an attorney to review the issue and perhaps contact the Insurance company about the issue. it would appear that the negligence of the agent could lead to you losing substanial business and if the insurance company was aware of this and your intention to hold them responsible if nothing is done may cause them to take action. Of course every situation is different and your case may turn on other facts or issues. best advice consult with an attorney.
