Legal Question in Insurance Law in Pennsylvania

Liability to pay auto damage cost

I am in a carpool and driving my carpool member's car was in an accident which resulted in front end damage to his car. He got claim from auto insurance company, elected to trade damaged car for new car. His auto insurance company gave him money for damages minus his $500 deductible amount. My carpool member wants me to pay deductible money. Am I liable to pay him this amount, since he didn't pay $500 upfront but had it deducted from amount insurance company gave him?

Re: Liability to pay auto damage cost

If you were negligent, and the accident was your fault, then you are probably responsible for the deductible. If he recovers the deductible from the other driver, then you should not have to pay.

Re: Liability to pay auto damage cost

If you were at fault in causing the crash, you would be liable. That is because the owner of the damaged car received $500 less than the value of the damage. Technically, your ins co may be responsible for the $500 you may owe. However, as a practical matter, I would not present the claim to your ins co, since it would be a chargable accident to you & may result in higher premiums for you. If you're being pushed to pay something, I would try to make a deal with the owner to pay him some money, but less than the $500. Hope the above helps!! Good luck.
