life insurance surviving child

My child's father died before she was born + the night before we were to be wed..he had 2 ins. policies w/his parents as ben..the one policy clearly states they are the ben. ''only if there is no surviving spouse or CHILD''...the government has already deemed her worthy of SS survivor benefits..I have questioned a few small town lawyers + with the 1st one he did file a claim on her behalf but we got nowhere with anyone. Isn't my child entitled to this $$...what is the limit for claiming this for her...she just turned 6 years old...the father died in June of 1999.

The time limit to sue the ins co is either 4 or 6 years from when your child turns 18, so you have time. The question is whether your unborn child had a right to the death benefit. I would need to review the ins policy. Also, weren't you the spouse & entitled to the death benefit?
