Legal Question in Employment Law in Pennsylvania

Labor/employment law

Situation: I am part of a team of professionals who were slated to relocate to the London, UK for a year or so to work on a major project. Upon learning what the ex-pat packages are going to need to be, the company is withdrawing the offer from ''married people with families,'' becasue it's ''too expensive.'' The rub is, they want those of us who are married with families to continue to travel back and forth and be away from our families for extended periods of time -to save money. Some of us don't want to do this. We would prefer to get off the project and move back to the states. Can the company threaten their jobs if they don't take what is offered i.e. the travel back and forth scenario? By the way, everyone has been operating on good faith for several months, trusting that this would be handled properly. Now that it hasn't been handled properly, they want to return to the states without fear of retribution. What are our rights?

Re: Labor/employment law

You asked about a job situation with an international component and a potential discrimination against married persons with families.

Normally I try to be very generous with responses on this board. But your situation is unique. You probably have some claims available to you and very likely can obtain some relief but you will need to speak directly with an attorney. There are too many facts and variables that would affect the analysis of the situation.

From the little information you provide, you can obtain some relief with a low risk of adverse job affect.

This is a matter of corporate compliance and employment which happen to particular areas of interest and expertise of mine.

Call my office to schedule an appointment. I don't offer free consultations, but I won't waste your time or mine if I can't help you.

Regards,

Roger
