Legal Question in Landlord & Tenant Law in Pennsylvania

Eviction

I gave my tenant a 15 day notice, and also a 30 day notice. But they are not moving out. Can we just move in, which would make them uncomfortable, and they would move out? We sold our house and want to live in our rental.

Re: Eviction

No you have to file for an eviction with the District Magistrate. This is required by the Landlord Tenant Act of 1951.

Taking possession other than by the tenants voluntarily moving is a self help eviction and could subject you to punitive damages if the tenant sued you.
