Legal Question in Landlord & Tenant Law in Pennsylvania

Rental Property

My current landlord is receiving a copy of our water bill he says he can use it on his taxes, We pay our own water bill so is he allowed to use our water bill on his taxes even though he does not pay the bill? He states he can because it is a rental property, I think this is incorrect and would like to find out the correct information to present to him. He claimed our water on his taxes last year and I want to make sure it doesn't happen again this year. Thank you--

Re: Rental Property

No. The only way he can deduct it from his taxes is as a business expense. His problem is he did not pay it. So he may have a problem with the IRS.

You can not claim the water bill as a deduction on you income taxes as it is not a tax. Just like your electric bill is not a tax.

The IRS defines a tax as money paid to a government unit for no particular purpose. So even if say there a charge on your tax bill for say garbage collection that is not tax deductible.
