Legal Question in Medical Malpractice in Pennsylvania

Toe injury misdiagnosis

I was injured playing basketball, when I went in for x-rays they indicated that it was a sprained foot. I was on crutches for the time they said to be, then 10 days later I went to my doctor and after x-rays I was referred to an Orthopaedic. She said that there was a fracture and I have been on a walking boot since, for 3 months now. The hospital is saying that the Physcian Assistant saw nothing, but the Radiologist saw a shadow but did not think it was significant to notify me. I was also told there was no way to tell if there was damage done while I walked on it for 10 days. I am currently on a bone stimulator because it is not healing and am currently discussing surgery now. Do I have a case in this matter, or is it something that I was unfortunate to have been dealt and now I have to deal with it, even if it does result into surgery.

Re: Toe injury misdiagnosis

This could be a failure to diagnose case, if we can get someone to testify that the first provider should have seen it. Definitely e-mail me or give our offices a call. I refer my clients to an outstanding medical malpractice firm.
