Legal Question in Personal Injury in Pennsylvania

auto accident

My husband was in an auto accident .. the driver of the other car was at fault.. going to fast. Hes 16. Are his parents responsible for the injuries my husband received? So far we're over $100,000 in bills. We have an attorney but, we dont think hes doing everything he can. We also have limited tort and the kids parents insurance have a cap of $100,000. My husband will be disabled after all of this,broke his femur and his ankle is destroyed . it has over 20 fractures in it plus screws and plates. He also has a fractured back which the orthopedic surgeon said he cant do anything about . Any info would be greatly appreciated. thank you

I'll answer the questions in the order you asked them:

1. Parents are not liable for son's conduct. Son was negligent and should be covered by the policy of the car he was driving.

2. There's a possibility that there will not be enough insurance coverage to adequately compensate your husband and pay his medical bills. Your atty has to investigate to determine how much insurance coverage there is, including your underinsured motorist coverage.

3. Your limited tort coverage should not be an issue b/c your husband sustained serious injuries.

4. Bad things happen to good people too frequently. Your husband may qualify for Social Security Disability once he's gotten all of the auto insurance money possible.

I agree with all the points answered by Mr. Senker in the previous reply you received. In addition, you really should have a heart to heart consultation with your attorney. Find our if he/she is really experienced in injury cases. If yes, find out his strategy and his thoughts on how to fully protect your husband. Make sure the lawyer has all the medical bills and reports. He/she should discuss those issues with you. If he/she is not experienced, ask him/her to refer to an experienced attorney. Good luck!!
