Legal Question in Personal Injury in Pennsylvania

Commercial vehicles and Limited Tort

My friend was in a car accident. She was 8 months pregnant at the time and hit by a commercial vehicle. The baby was born five weeks premature and is now suffering some complications not yet diagnosed. The mother was hospitalized for some time and has been suffering from back problems and neck problems. She has limited tort. Is it true that limited tort is null and void because she was hit by a commercial vehicle?

Re: Commercial vehicles and Limited Tort

Limited tort does not apply only if you are a passenger in a commercial vehicle. The injured party should still see an attorney to help determine if her injuries are "serious" and therfore recoverable. The baby may bring an action also.
