Legal Question in Real Estate Law in Pennsylvania

have a well on property drilled when purchased house 16yrs ago worked well up to 2 1/2 yrs ago having contaimination #2 fuel oil in well. Have a house next to me cut lines to his tank in ground, now has above ground tank. had dep look into cause of well problems, tested , found #2 fuel oil. Ask about forcing nextdoor property to extract old tank and also seek damages for well damage. The dep states they have no recorse or can do anything to help in lawsuit or to make me whole or back to what i had. How can I go further in this or higher up with dep legally. Dont know what to do or if had good case to get back what I have in my property?

It will probably cost the same in the long run to sue the neighbor, and you can only get full compensation suing the neighbor.
