Legal Question in Social Security Law in Pennsylvania

social security disability

I am unable to work. Can I collect social security disabilty and will my wifes income affect it? I do not have enough credits to get it on my own.

You need to have worked and paid FICA 20 out of the last 40 quarters of work. If you do not have enough credits, you are not eligible for Disability Insurance. Your wife's income is not a factor for Disability insurance.

You may apply for SSI based on your disability but because others in your household have income, you may not be eligible because SSI is a needs-based program. Contact your local Social Security office to see if you qualify for either program.
