Legal Question in Workers Comp in Pennsylvania

insurance company running out of money

i have been on workers comp for approx 3 mnths, all of a sudden when it is time for me to recieve my biweekly check the ins comp said they ran out of money. my boss is telling me he need s tio hire a person to take my place and im thinking he is going to fire me as sooon as im cleared to go beack to work. any advice?????

If the insurance company ran out of money they will be taken over by the State and you will be paid your compensation but anytime that you are able to go back to work, you should. It does violate Pennsylvania public policy to fire a person because they have used compensation benefits and that could give you a viable lawsuit but lawsuits are always risky and they may take years. If you don't have any other option, and don't have any other means of livelihood, then you should consider some type of employment within your present limitations.
