Railroad Accidents and Workers Compensation

My husband was involved in an accident in the employee parking lot at his job. He was hit by the engine of a speeding train. He has been out of work for over a year and all of his benefits have been terminated. What type of recourse does he have while waiting for this claim to be settled, as he has filed sue against his employer? Also, how long does it normally take for a lawsuit like this to be settled?

You need to give further information: was your husband an employee of the railroad or did the railroad have a right of way through his employers area? The answer to this question will determine if your husband can collect PA Workers comp or if he has a cause of action under the FELA. Even if he is covered by comp you may still have a third party claim against the railroad. I have extensive experience in suing railroads as well as handlin comp cases.
