Legal Question in Appeals and Writs in Philippines

Bond

Thanks for the previous answer.

The Bond Company refuse to release/pay us the bond we claim.

The Judge in lower court of Antipolo City issued a writ of execution to a certain bond company in manila ''a writ of execution'' for confiscated bond on January 31, 2006 then the sherif send them a ''notice/Demand for payment upon writ of execution on feb 02, 2006 but then the bond company submit a ''Urgent Motion'' to quash the writ of execu dated January 31, 2006. Our attorney did not file any motion after this because there is a writ and no need to file a motion etc.. Is this correct?

Later on August 2006 we are schedule by insurance commsion to be heard then after second meeting the certain bond company did not appear for some cases and this bond file again showing to the commision some documents cases with a case that an another insurance with same situation like ours versus a claimant have granted. Until now the insurance commision have no reply to us to decide.

I am writing these coz i have no enough money to pay for the attorney service. I know this case will go long.. hope i can have a quick answer.

God Bless.

Re: Bond

No motion is needed because there is already a Wirt. The MOtion to Quash filed by the bonding company should first be resolved by the court of Antipolo. The Insurance Commission has no business yet to resolve the issue because this is covered by the Antipolo's jurisdiction. YOu have to wait till the motion to quash is resolved by the court.
