Legal Question in Family Law in Philippines

Changing the surname of my child

My son's surname followed to his father's surname eventhough we were not married. My question is, Is it possible to change the surname of my son and instead he will used the surname of my husband. Do I need the permission of his father even if after our son was 2 months old he did not show up. Please advise.

Yes. Your husband, to whom you legally married, should first adopt your son, in order your son can validly used your husband surname.
