Legal Question in Real Estate Law in Philippines

If a contract for an apartment states that it will start on December 6th of 2011 and will end on the December 5th of 2012, and that on the following year if the lessee would like to still continue renting, that the rate will go up let's say from 13k to 15, my main concern is 1) If the lessee, for some reason, is stating that base on their last payment that would cover December 6th of 2012 to January 5 of 2013, they will just pay 13k still and 2nd for the following month since they are insisting that January 6th to February 5th of 2012 is their the start of their new contract but they wish for their advance payment from last year to be used, can I now have pay me for a new advance payment? 3) and also since coming from the previous contract the advance was just 13k in total should I still have them pay the missing 2k?

You can use the previous deposit and just demand for the difference.
