Legal Question in Family Law in Rhode Island

Court ordered visitation violations

How can I get modified visitation and possibly sole custody, in a court ordered arrangement that includes joint custody and weekend visitation with father, with my having physical placement. Repeated violation of visitation order, father not administering prescription medication on weekend, possible unsafe atmosphere. DCYF will not investigate. What plan of action do I take?

Re: Court ordered visitation violations

The Family Court's primary concern in such matters is the best interest of the child. As such, the Family Court may modify a prior order upon sufficient evidence of a change in circumstances or evidence of a risk to the health or well being of the child.

If you believe circumstances exist in this case to justify such a modification, I suggest you see a lawyer. If you need counsel, feel free to review our qualifications at "www.montsum.com" and give me a call Monday if you would like to schedule a free consultation with our firm's domestic relations expert.

In any event, though, the Court will not deny a parent visitation with his or her child except in the most severe cases. I hope this helps.
