Legal Question in Personal Injury in Rhode Island

Cancellation of Arbitation/Mediation hearings

I have had two scheduled arbitration hearings (for the same personal injury case) which have now been cancelled by the other attorney. The first (scheduled for April 2003) was cancelled just days before....that attorney stated that she had to cancel and turn it over to another attorney due to a ''conflict'' of interest. It was rescheduled for July 2003...with a new attorney and has once again been cancelled (New attorney says she is not ready)and rescheduled for October 2003. Is this ''legal''? How many times are these attorneys allowed to cancel at my expense? I have had to submit to take these days out of work and change my own schedule.....Do I have any recourse? Can they be forced to keep the date?

Re: Cancellation of Arbitation/Mediation hearings

The answer to your question depends upon numerous factors including whether the arbitration hearing is consentual or court ordered and what the grounds were for this "conflict of interest" that apparently suddently developed. Without more information, your question cannot fully be answered.
