Legal Question in DUI Law in South Carolina

My brother was pulled over and charged with driving under suspension 3rd time. Also he was classified as a habitual affender a few years ago when he was pulled over a few times within one year for DUS...Do you think he will get jail time? Do u think getting a lawyer would help? Also his court date is in DEC. What are the chances of getting a later court date? Really hope he's not in jail for Chritsmas. =(

There is a good chance of getting that reduced to a Second Offense with a fine and no jail. He really needs a lawyer however. My firm is in Horry County if it happens to be here or near here.
