Legal Question in Family Law in South Carolina

Changing the birth certificate & name of our son.

This is an odd situation. My Boyfriend & I had a baby last year. However, he was going through a divorce at the time. Being a scared young woman, I didn't put him on the birth certificate or give the baby his last name. I was scared that something could happen with his divorce, (which i know now was stupid & nothing could've happened). I was wondering what it would take to get his birth certificate & name changed to the right thing? As long as he & i both agree that our son is in fact OURS, would it be pretty simple?

Re: Changing the birth certificate & name of our son.

It's not simple due to certain procedural "hoops" that must be jumped through, but it's not overly difficult either. Both the name change and the paternity issue can be addressed in the same action.

I suggest that you schedule an appointment with an experienced family law attorney in your area to discuss the process and the costs involved.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
