Legal Question in Family Law in South Carolina

Child visitation

My daughter is 13. Her father and I have been divorced for approximately 9 years. In our papers, he didn't want structured visitation but he saw her whenever he wanted to. Now, he wants to go to court for written visitation even though my daughter doesn't care to see him anymore. Is there an age, of the child, where it makes a difference in the decision?

Re: Child visitation

The Court will take the child's wishes/desires/preferences into account, but the decision lies with the Court and not the child. There are many factors that the Court will take into account when determining what is in the child's best interest.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
