Legal Question in Family Law in South Carolina

Divorce and Adultery

A friend of mine is in the process of seeking an attorney to file for divorce. They have been married 19 years, have 2 children (15 and 16). She was recently caught having an affair and even though he has admitted to one, he has proof of hers. He has threatened to take the children, house etc. and she is a basket case right now. She wants to leave but is afraid of his threats and losing her girls who she has raised mostly herself. Can he do those things to her?

Re: Divorce and Adultery

Divorce and custody cases are very complex, and it is not possible to say what will happen in any particular case without knowing much more information. The short answer is that outside of abuse and neglect, there are no single issues that cause someone to lose custody by themselves.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that your friend consult an experienced family law attorney to find out what options are available to her based on the facts of her particular case.
