Get a doctor to say that it is dangerous for him to drive at night or in a busy city. Then hire an attorney to present this evidence to the court to establish an order that says that your husband cannot drive his/your three year old at night or in the busy city.

If you believe that he is endangering the child, you can bring an action in Family Court to have the Court restrict what he does when the child is with him. It will most likely come down to what his physician says and whether the State has restricted his driver's license in any way.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
