Legal Question in Family Law in South Carolina

I pay all bills, work full time,my wife works part time.We have two sons 13 & 10.I provide health ins. dental ins. life ins. etc.We have decided that we should be divorced.I know we have to be separated for 1 year before we can procede. She says she knows her rights and can have me removed from the house.(evicted?) There has been no abuse, adultery (at least on my part) or any other grounds for me to have to leave.(She had originally agreed to move out but changed her mind.)Is there any way she can do this? We have been married 16 years. Thanks in advance for the answer!

The Court will not make either of you move out if there are no fault grounds. These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.SpartanburgLawyers.com). I wish you the best of luck.
