Legal Question in Real Estate Law in South Carolina

family concerns

My grandmother died and left her house and land to me. The property was in both of our names for me to take over upon her death. My family is concerned that my husband will take everything upon my death or one half in a divorce? Are these valid concerns?

You have asked a very intelligent and reasonable question and I commend you for being smart enough to ask. However, legal questions such as these are rarely simple nor can be answered without an attorney knowing many many things. A family law lawyer would need to know the length of the marriage, the differences in income between the husband and wife, the grounds for divorce, whether alimony is being legally pursued, the facts, evidence of the allegations, etc., etc. The last thing you would want would be an off-the-cuff answer to such an important question. Inheritances are usually treated different than normal marital assests. However, you owe yourself a complete and accurate answer to your concern. The best thing you can do is make an appointment with a family law attorney who can go over all of the things I have explained and other matters to be in a position to help you and so you have the necessary understanding of where you are legally.
