DUS, How can I have a 1st and 4th offense at the same time?

In South Carolina; I have a pending DUS for 4th offense. But I don't really think it should be a 4th offense.

About a couple of weeks ago was charged with DUS 1st. I payed the fine just as I was suppose to do.

I have a pending charged that happened like two weeks later that has not went to trial, but they said the charge is DUS 4th offense. It does carry mandatory jail time.

What are the chances of getting the charge dropped down to a 2nd offense b/c my most recent was a DUS 1st.

I feel so stupid because my suspensions time was up, but i did not pay the reinstatement fees because I had an injunction placed on by an insurance company several years ago. This time when the judge released me he told me that the suspensions do not come off until I paid the reinstatement fees. I could have been paid those, i always assumed i had to pay the insurance fees associated with the injunction.

When they give a DUS charge all they do is count the number of previous DUS convictions. So if you were convicted in the past of say two DUS First Offenses, then they can write up the 3d one as a DUS Third Offense.

It is possible to get the 4th offense reduced to a second offense. They don't always agree to that, but at times they do. Each person and each case is treated differently.
