Legal Question in Traffic Law in South Carolina

Handicapped Parking Violation

My daughter received a Handicapped parking violation and did not tell me (car in my name). Received certified mail to appear in court. Trying to get hold of Officer who will be there but doesn't return my calls. Max fine $440 and 10 days in jail and could issue bench warrant. Since I'm out-of-state what can I do without showing up? Will they just issue fine? Do bench warrants transwer to another state so that if you are stopped they could arrest you? Anything I can send court to state my case prior to case?

Re: Handicapped Parking Violation

In Michigan, a handicapped ticket is a civil infraction. No civil infractions carry a possible jail sentence. The penalty is a fine, and I suggest that you just pay the fine and then get reimbursed by your daughter or vice versa. The infraction does not get abstracted to your driving record nor does it carry any points.

Usually it states on the ticket (front or back) if you need to appear in court, or if you can just pay the fine without showing up. I am reluctant to tell you either way without seeing the ticket. I would advise you to call and discuss this with the court. It would also be advisable to contact an attorney and discuss this with him/her. Good luck.
