ticket for shoulder belt

Can a driver receive a ticket for a passenger under 17 who puts their shoulder belt under their arm instead of over their shoulder?

I would need to double check the wording of the statute. I would also need to make sure that the ticket was written per a state law and not any sort of a county or city ordinance. If you would like to email me what is called the "VIOLATION SECTION NO."
