Legal Question in Immigration Law in South Dakota

Permanent residency through marriage

I am a Malaysian citizen working at South Dakota State University in Brookings, SD. I currently hold an H-1B visa. I married an American citizen in November 2002.

I'd like to know what needs to be done in order for me to become a legal permanent resident. What forms do I need to fill out? What forms does my wife need to fill out?

Any information you can give be most appreciated. Thank you.

Re: Permanent residency through marriage

Since you are currently on H-1B status, your wife should file an Alien Relative Petition on your behalf, and you will thereupon need to apply for an adjustment of status with the Bureau of Citizenship and Immigration Services ("BCIS") . In addition, you should be cognizant of any issues pertaining to travel documents, such as an advance parole for emergent personal reasons, as well as work authorization and an affidavit of support (and a co-sponsor affidavit if required) to comply with the Minimum Poverty guidelines of 2003.

If you would like to discuss this in more detail, please telephone the office at (212) 618-1830 to speak with an attorney.
