Property in Spain

Dear sirs,

I would be very grateful to you if you could advise me on the following.

I’m Russian and I’m planning to buy a flat in Spain. I want to have only my name as the owner in Escritura.

If I was doing it in Russia by law it would be necessary to have a legal document from my husband confirming that he agrees that the property will be bought only for my name. I’ve never seen any mentioning of anything like that for buying procedure in Spain.

Do I need an official permission from my husband or it’s not necessary in Spain?

From the Spanish legal pointview, it is not requested to obtain this permission from your husband when acquiring a real property in Spain.

The permission is requested when selling the permanent home, provided that some particular conditions are met(Spanish nationality, applicability of the Spanish regime to the marriage)
