Legal Question in Disability Law in Tennessee

Job requirements

I work 3rd shift under job title material handler there are 5 per each shift. On days there is an older man who was hurt ( hand/ arm limited use on right side) many years before. Until recently he performed a job where he did ''light work'' Until layoff and role back of workers. He does not perform almost all of duties required of other material handlers on any of the three shifts. He is allowed by company and management to do so. Is this some type of discrimination based on because I/we are able to do the work because we are not disabled and he is.

Re: Job requirements

A person claiming discrimination must be the one who is being discriminated against. How are you being damaged by the continued employment of the man in question? If you are not being harmed you have no legal cause of action.
