Legal Question in Bankruptcy in Tennessee

who has the last word ???

My wife filed chapter 7 in sept. she has property that has equity. The trustee wants her to pay something to the court, but has not decided how much yet.In the mean time, the judge discharged her debts. Does the judge's decision stand or can the trustee make her pay ???

The administration of bankruptcy assets is independent of the discharge of the debtor. If your wife has none exempt assets that are included in the bankruptcy estate, the trustee has the obligation to administor them and distribute them to creditors. The two issues here would appear to be 1.Is the asset exempt, 2 What is the value of the asset. The debtor is entitled to dispute the trustees position in either of these areas.
