Legal Question in Credit and Debt Law in Tennessee

Merchandise not received

I live in MA; I sent a personal check to someone in TN for promised merchandise. He never delivered. I want my money back. He keeps claiming the mdse. was lost in mail and that he will return my money, but hasn't. It has been 30 days. I have numerous emails from him stating he will return my money. How do I proceed to legally collect my money? I have a signed reciept that he received and cashed my check. Also, I have his email address and cell phone #.

The letter may convince this person to either send you the merchandise or refund your money.
